Thank you for choosing Glamu, an innovative mobile application developed by Adrian Koczeń. Glamu allows you to see yourself in various digital outfits using advanced artificial intelligence based on your uploaded photos.

These Terms and Conditions ("Terms") govern your access to and use of Glamu and its related features, including AI-generated content and social sharing capabilities. By accessing or using Glamu, you agree to be legally bound by these Terms. If you do not agree, you must not use the app.

Please note that access to Glamu may be restricted or limited in certain jurisdictions due to legal or regulatory constraints.

2. Acceptance of Terms

By accessing or using Glamu, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated into these Terms by reference.

These Terms constitute a binding legal agreement between you and Adrian Koczeń, the owner and operator of Glamu. You confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. Use by individuals under the age of 18 is strictly prohibited, regardless of how the app may be rated or categorized on distribution platforms.

If you do not agree to these Terms or the Privacy Policy, you must immediately discontinue use of the app.

Glamu is intended solely for users who are at least 18 years of age and are legally permitted to use the app under applicable laws. By using Glamu, you confirm that:

Adrian Koczeń reserves the right to restrict or block access to Glamu in certain regions or jurisdictions at any time, for any reason.

4. Service Description and AI-Generated Content

Glamu is a mobile application that enables users to generate AI-powered outfit visualizations using their own photos. The app uses artificial intelligence to produce stylized images that simulate how various clothing items might appear on the user.

• AI-Generated Content: All visuals are generated by machine learning algorithms and are influenced by the quality of the input photo, selected clothing, and system limitations. The outputs are synthetic and do not reflect real-world fit, texture, or appearance.
• No Guarantee of Accuracy: Generated content is for illustrative and entertainment purposes only. Glamu does not guarantee the accuracy, realism, or suitability of any visual representation.
• Use Restrictions: You may not upload or attempt to generate content that includes:
  • Nudity, explicit, obscene, or sexually suggestive material
  • Violence, gore, or disturbing imagery
  • Hate speech, discriminatory, or offensive content
  • Images of public figures or celebrities without documented consent

Violating these terms may result in immediate suspension or permanent termination of your access to the app, without prior notice.

5. User Accounts and Security

To access Glamu’s full functionality, an account may be created and associated with your device. In most cases, this account is linked directly to your device without requiring a separate username or password.

• Device Responsibility: You are responsible for maintaining the security of your device. Any activity that occurs on your account due to access through your device is your responsibility.
• Account Usage: You may not transfer, clone, or use your account on another device unless explicitly permitted.
• Security Events: If your device is lost, stolen, or compromised, you must notify us promptly so we can take appropriate steps to protect your data and account.

Glamu implements reasonable technical and organizational measures to safeguard your information, but you are ultimately responsible for securing access to your device and ensuring its proper use.

Adrian Koczeń reserves the right to suspend or terminate your access if there is evidence of unauthorized use or a security risk associated with your account.

6. User Responsibilities and Prohibited Activities

By using Glamu, you agree to use the app responsibly and in compliance with all applicable laws and these Terms. You must not use the app in any way that infringes on the rights of others or disrupts the experience for other users.

• Upload, generate, or share any content that is illegal, defamatory, obscene, offensive, or otherwise inappropriate.
• Use the app to violate any intellectual property, privacy, publicity, or other rights of any person or entity.
• Attempt to access, tamper with, or disrupt the app’s infrastructure, servers, or systems.
• Reverse-engineer, decompile, or attempt to extract the app’s source code or AI models.
• Use automated tools (such as bots, scrapers, or crawlers) to access or interact with the app without written permission.
• Bypass any security measures or exploit vulnerabilities in the app.
• Use the app in a way that could damage, disable, or impair its functionality, or interfere with other users' access or experience.

Violation of these rules may result in immediate suspension or permanent termination of your account, and may expose you to legal consequences. Adrian Koczeń reserves the right to monitor, review, and remove any content or activity that violates these Terms or applicable law.

7. Intellectual Property Rights

Glamu, including its design, content, software, and features, is owned and operated by Adrian Koczeń. All intellectual property rights associated with Glamu, including copyrights, trademarks, trade secrets, and patents, are either owned by or licensed to Adrian Koczeń.

User-Generated Content

• Limited License Grant: You grant Adrian Koczeń a worldwide, royalty-free license solely to store and display your content within Glamu’s services. Glamu will not modify, distribute, translate, create derivative works from, or otherwise alter your content.
• Content Ownership and Permissions: You confirm that you own or have the necessary permissions to use and license the content you upload to Glamu. You also ensure that the content does not infringe on any third-party rights.
• Prohibited Content: You agree not to upload or submit any content that includes:
  • Nudity, obscenity, or sexually explicit material
  • Violence, gore, or disturbing imagery
  • Offensive or discriminatory content
  • Public figures or celebrities without explicit permission
• Right to Review and Remove Content: Glamu reserves the right to review, monitor, and remove any content you upload without prior notice if it violates these Terms or any applicable law.
• Responsibility for Uploaded Content: You are solely responsible for the content you upload to the app and any consequences arising from its use. Glamu disclaims all liability for user-generated content.

8. Fees and Payments

Glamu offers certain features through in-app purchases (IAP), which may enhance your experience or unlock additional content and functionality. By making any purchases within the app, you agree to the following:

• Payment Method: All payments for in-app purchases will be processed through your account with the respective platform where you downloaded the app. You must have a valid payment method on file with the platform to complete any transaction.
• Pricing: Prices for in-app purchases will be clearly displayed in the app. These prices are subject to change at any time, and any such changes will apply to future purchases.
• Refund Policy: All in-app purchases are final and non-refundable, except where required by law. If you encounter any issues with your purchase, please contact customer support for assistance.

You acknowledge and agree that Adrian Koczeń is not responsible for the availability, accuracy, or content of these third-party services, nor for any damages or losses incurred as a result of your use of such services.

It is your responsibility to review and understand the terms and conditions and privacy policies of any third-party services you access through Glamu. Adrian Koczeń disclaims all liability for any harm or loss caused by your use of third-party services.

10. Termination

You may terminate your use of Glamu at any time by deleting your account through the app’s settings or through any other provided method. Upon deletion, all your account information and uploaded media will be permanently removed from our servers.

Adrian Koczeń reserves the right to suspend or terminate your access to Glamu and your account, without prior notice, for any reason, including but not limited to:

• Violation of these Terms.
• Engaging in prohibited activities as outlined in these Terms.
• Unauthorized use or abuse of the app or its features.

Upon termination, whether initiated by you or Adrian Koczeń, your right to use Glamu will cease immediately, and you must stop all access and use of the app. Adrian Koczeń is not liable for any damages or losses resulting from the termination of your access to Glamu.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Adrian Koczeń, its affiliates, and their respective officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Glamu, including but not limited to:

• Loss of profits or revenues
• Loss of data or information
• Personal injury or property damage
• Any unauthorized access to or use of our servers or personal information stored therein

In no event shall Adrian Koczeń's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for using Glamu during the twelve (12) months preceding the claim.

This limitation of liability applies regardless of whether the damage or loss was caused by the app's operation, user negligence, or other factors, and shall survive any termination or expiration of these Terms.

12. Governing Law and Jurisdiction

These Terms, and any disputes arising out of or related to your use of Glamu, shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts located in Poland. By using Glamu, you consent to the personal jurisdiction of such courts and waive any objections to venue or inconvenient forum.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

13. Changes to Terms

Adrian Koczeń reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms within the app or notifying you through other means. Your continued use of Glamu after such changes constitutes your acceptance of the updated Terms.

It is your responsibility to review these Terms periodically for any updates or changes. If you do not agree with the updated Terms, you must stop using Glamu immediately.

For significant changes, we will make reasonable efforts to notify you, but you should regularly check for updates.
